Terms of service

Version 1.0 · 26 October 2026

These are the terms for using Afiyet, the online staff app by Sublimed.io (KVK 93179545, Amsterdam). By signing up a venue you agree to them. We keep it short and in plain language. The Dutch version is the binding one.

1. Who and what

Afiyet is offered by Sublimed.io (KVK 93179545, Amsterdam), "we". You are the venue (restaurant, bar, café or other hospitality business) that creates an account, "you" or "the venue".

Afiyet is a web app for rosters, availability, hours, clock-in, tips and reports, used in the browser on phone, tablet or laptop. It is for business use; consumers cannot create an account.

2. Account and team

The person who signs up must be authorised to act for the venue. You are responsible for whom you invite, which role you give them and what they do in the app.

Everyone logs in with their own email address and password. Don't share passwords. Report misuse or a suspected breach to us right away.

3. Price

You pay monthly: a minimum of €70 per venue, which includes up to 15 active employees, plus €4.50 per active employee above that. All prices exclude VAT.

An employee is 'active' when there is a current employment in Afiyet on the billing day. Someone who has left or starts later doesn't count.

Founding rate: venues that sign up with a founding code pay €3.75 per active employee above the minimum, fixed for 24 months from the first payment, then the standard rate. The €70 minimum applies to founding venues too.

We announce price changes at least 30 days ahead by email. A running founding rate does not change.

4. Payment

You pay the first month at signup by iDEAL, SEPA direct debit or card. After that we charge automatically each month on the same day of the month, based on the number of active employees on that day. Payments run through Stripe; we never store bank or card numbers.

You receive a monthly invoice by email. Invoices, payment method and cancellation are handled in the customer portal (Subscription in the app).

If a charge fails you get an email and 14 days to fix it. After that we may pause access until it is paid. Your data is kept during that time.

5. 30-day money-back guarantee

If you are not happy within 30 days of your first payment, we refund that first month in full. Send us a message (email or WhatsApp), that's all. We then close the account.

This applies once per venue and not to venues that had an account before.

6. Term and cancellation

The subscription runs monthly and renews automatically. You can cancel at any time in the customer portal; it ends at the end of the current month. There is no notice period. Outside the 30-day guarantee we don't refund part of a month.

We may end the subscription for misuse, for non-payment after the 14 days in section 4, or if we discontinue Afiyet — in that case with at least 60 days' notice and an export of your data.

7. Your data

Everything you put into Afiyet stays yours and your venue's. We use it only to provide the service, never to sell to third parties or for advertising.

You can download month reports as Excel at any time. After termination you can request a full export for 30 days; after that we delete your data (backups within 30 days after that).

For your employees' personal data you are the controller and we are the processor. The processing terms in section 8 are part of these terms.

8. Data processing terms (GDPR)

We process your employees' personal data only on your instructions and only to provide Afiyet. We take appropriate technical and organisational measures: encrypted connections, per-venue data isolation in the database, EU hosting, and logging of changes to hours.

We use these sub-processors: Supabase (database and authentication, EU — Stockholm), Vercel (app hosting), Stripe (payments), Brevo (email, EU) and the Apple and Google push services for phone notifications. New sub-processors are announced 30 days ahead; you may object.

In case of a data breach affecting your employees we inform you without undue delay and at the latest within 48 hours of establishing it. We assist with employee requests (access, correction, deletion) and with a data protection impact assessment if needed.

After termination we delete the data as described in section 7 and confirm deletion in writing on request.

9. Availability and support

We do our best to keep Afiyet available at all times but do not guarantee 100% uptime. Planned maintenance happens outside peak hours and is announced. Outages are reported in the app or by email.

Questions go through the WhatsApp button in the app or by email; on working days we reply the same day.

10. Use

You use Afiyet for your own venue and your own team. You don't try to bypass security, copy the service, or use the app for anything unlawful.

Afiyet helps with rosters, hours and the rules of the Dutch hospitality collective agreement (CAO Horeca), but it is not payroll software or legal advice. Checking salaries, filings and CAO application remains the responsibility of the venue and its accountant or payroll provider.

11. Liability

Our liability is limited to the amount you paid us in the three months before the event. We are not liable for indirect damage such as lost revenue or third-party fines, except in case of intent or gross negligence on our side.

12. Changes and law

We may change these terms. Material changes are announced 30 days ahead by email; if you don't agree you can cancel before they take effect.

Dutch law applies. Disputes go to the court of Amsterdam. Questions about these terms: hello@sublimed.io.
